The Lynx mobile application (the “App”) is operated by The Toro Company and its subsidiaries and affiliates (collectively “we,” “our” or “us”). The App is available only to employees of businesses which have subscribed to this service for professional use. The Privacy Policy describes the personal information collected when you install and use the App, how we use it, how we share it, how we protect it, and the choices you can make about your information. Throughout this Privacy Policy “information” includes personal information about you. This Privacy Policy does not apply to information that we collect any of our websites or other mobile applications.

CONSENT:

If you are located outside of the United States, please note that the App is hosted in the United States. Therefore any information provided pursuant to the App may be processed and stored in the United States. As a result, United States federal and state governments, courts or law enforcement or regulatory agencies may be able to obtain disclosure of your information through laws applicable in the United States. Your use of the App or your submission of any information to us will constitute your consent to the transfer of your information outside of your country of residence, which may provide for different data protection rules than in your country. Information We Collect

We collect the following types of information in the manner described below.

1. When you download the App, we will automatically collect the following information about your mobile device which is needed to ensure that you have access to the App and for it to work properly:
  • Unique device identifier;
  • Operating system;
  • The model and serial number; and
  • Information regarding access to and use of the App from your device.
2. In addition, you may voluntarily provide us with additional information, including:
  • Your name, email address, telephone number, user name and password
  • Information when you contact or interact with us.
3. We may collect your geographic location if you request that we do so in order to maximize the benefits of the App. We will not collect this information without your consent. 4. We may combine all of the information we collect from or about you and use it in the manner described in this Privacy Policy.

How We Use Your Information

We use the information that we collect for the following purposes, including:

  • The purposes for which you provided it;
  • To verify that your mobile device is licensed to use the App;
  • To provide the App to you, including any notifications or updates relating to the App;
  • To create or add to your user profile or registered account;
  • To process and respond to your inquiries and comments;
  • To send you information about your relationship or transactions with us;
  • To improve the App or to develop new products and services;

· To allow you to participate in surveys;

· To create anonymous data, or compile aggregate data which we may use for internal and external business purposes;

· To analyze the App;

  • To allow us to personalize and enhance your experience using the App;
  • To send push notifications through the App;
  • To send emails;
  • To generate and review reports and data about our user base and service usage patterns;
  • To analyze the accuracy, effectiveness, usability or popularity of the App;
  • To prevent fraudulent transactions, monitor against theft and otherwise protect our users and our business;
  • To administer and troubleshoot the App; and

How Your Information is Disclosed

Information may be disclosed to third parties in accordance with our Privacy Policy.

1. Third Parties. We may use third parties to perform functions in connection with the App (for example, data analysis and marketing services). We may share information about you that they need to perform their functions and in accordance with our agreements with them.

If we become involved in a merger, acquisition, sale of assets, joint venture, securities offering, bankruptcy, reorganization, liquidation,dissolution, or other transaction or if the ownership of all or substantially all of our business otherwise changes, we may share or transfer your information to a third party or parties in connection therewith.

3. Subsidiaries and Affiliates. We may also share your information with any subsidiary or affiliate of ours for purposes consistent with this Privacy Policy. Any subsidiary or affiliate of ours will be required to maintain that information in accordance with this Privacy Policy.

  • Enforce or apply the Terms or any applicable end user license agreement;

  • Establish or exercise our rights to defend against legal claims; or

Technologies

We use App Settings. App settings are settings on your mobile device which may be used for tracking, analytics, personalization and optimization of the App. You may control your app settings, for example if you choose to receive notifications, through use of the “settings” feature on your mobile device.

Security

While we take reasonable technical and organizational measures to protect the information you submit via the App against loss, theft and unauthorized use, disclosure, or modification, we cannot guarantee its absolute security. No Internet, email or mobile application transmission is ever fully secure or error free.Email or other communications sent through the App may not be secure.You should use caution whenever submitting information through the App and take special care in deciding which information you provide to us.

Your Choices Regarding Your Personal Information

You have choices regarding the use of information on the App.

1. Changing Your Personal Information. You may make changes to or request deletion of your personal information by contacting us atlegal@toro.com.

2. Retention. We will retain the information collected through the App for as long as it is useful to the Lynx subscriber and in accordance with the terms on this Privacy Policy.

Children

We do not knowingly collect personal information from individuals under age 13. If you are under the age of 13, please do not submit any personal information through the App. If you have reason to believe that we may have accidentally received personal information from an individual under age 13, please contact us immediately at legal@toro.com.

Changes to Privacy Policy

We may change this Privacy Policy from time to time. We encourage you to review this Policy periodically to ensure that you are aware of current practices. Any use of the App following the date on which we implement changes to this Policy shall constitute your acceptance of all such changes.
